Terms & Conditions

1. Introduction

  • These Terms and Conditions ("Agreement") govern the relationship between Mauresk ("Company," "we," "us," or "our") and clients ("you" or "your") booking travel services through us. By booking a trip with Mauresk, travelers are bound by both these Terms and Conditions and the Need-to-Know Information document.
    The Need-to-Know Information document is incorporated into this Agreement and is binding on all travelers.
2. Booking and Payment
  • 2.1 Booking Confirmation Your booking will be accepted on the basis of these Terms and Conditions. The services provided will be as outlined in your booking confirmation invoice. References to "you" and "your" in this Agreement include the first named individual on the booking, all individuals on whose behalf a booking is made, and any individual added to or transferred to the booking.
    A booking is confirmed when we receive the required deposit (30% of the total trip cost), and you receive a written confirmation from us. Please review your confirmation carefully and inform us immediately of any discrepancies.

  • 2.2 Deposit and Final Payment
    • Deposit: A non-refundable deposit, calculated as 30% of the total trip cost, is required to secure your booking. This deposit is used to cover administrative and preparatory costs, as well as non-recoverable payments made to third-party suppliers upon booking confirmation. By making the deposit, travelers acknowledge and agree to its non-refundable nature, regardless of subsequent cancellation or trip adjustments
    • Final Payment: The balance is due 60 days before the trip's departure date. If booking within 60 days of departure, full payment is required at the time of booking.
    If the final balance is not paid on or before the due date, we reserve the right to treat your booking as canceled. In such cases, the cancellation charges outlined in clause 3.1 (Cancellation by You) will apply.
  • 2.3 Payment Methods We accept payments via credit card, bank transfer, or other methods as specified at the time of booking. All payments must be made in U.S. dollars. Outstanding balances may be adjusted to account for currency fluctuations occurring before final payment.

  • 2.4 Your Information To confirm your travel arrangements, you must provide all required details at the time of final payment. Necessary information varies by trip and may include your full name as it appears on your passport, a copy of your passport, date of birth, nationality, passport number, passport issue and expiry dates, and details of any pre-existing medical conditions that may affect your ability to complete the trip.
    Failure to provide accurate and complete information may result in delays, additional costs, or cancellation of your booking, for which Mauresk will not be held liable.
    For certain trips, additional forms, such as a Self-Assessment form, may be required and will be provided by your Mauresk representative. Please refer to our Privacy Policy for details on how your personal information is managed.

  • 2.5 Inclusions and Exclusions Trips include services and activities specified in the itinerary, such as accommodations, meals, guided tours, and transportation, as outlined. Exclusions may include items such as international flights, personal expenses, optional activities, and travel insurance. Details on inclusions and exclusions are provided in your booking confirmation. Optional add-on activities may be available for an additional cost, subject to availability and itinerary compatibility.
  • 2.6. Waiver Requirement Travelers may be required to sign a waiver prior to or during the trip. This waiver, if applicable, will outline specific terms, conditions, and acknowledgments for participating in the activities included in the itinerary. Failure to sign the waiver may result in the inability to participate in certain activities, and no refund will be provided in such cases.

  • 2.7 Minimum Age The minimum age to participate in Mauresk trips is 15 years. Travelers under the age of 18 must be accompanied by a parent or legal guardian throughout the trip. The parent or legal guardian assumes full responsibility for the actions and well-being of the minor during the entire duration of the trip.
  • 2.8 Maximum Age Mauresk does not impose a maximum age limit on its trips, as part of our commitment to inclusivity. However, certain itineraries, such as trekking or physically demanding activities, may require a higher level of fitness and endurance. It is the traveler’s responsibility to assess their own physical capabilities and consult with a physician if necessary before participating in such activities.
  • 2.9 Minimum Participants Requirement All Mauresk trips require a minimum of 4 participants to guarantee departure. If fewer than 4 bookings are received, travelers will be presented with the following options:
    • Pay an additional fee to cover the cost of operating the trip, or
    • Reschedule the trip to an alternate date.
    Travelers are free to choose their preferred option, but no refunds or compensation will be provided for changes resulting from insufficient participant numbers. Mauresk reserves the right to determine the additional fee amount based on the specific trip and associated costs.
  • 2.10 Single Rooming Options For travelers seeking single accommodations, Mauresk offers this option on most trips for an additional fee. The cost of the single surcharge varies based on factors such as the trip, season, and availability and will be confirmed at the time of booking. Single rooms are subject to limited availability, so we recommend requesting this option as early as possible. In cases where single rooms are unavailable, we will arrange suitable alternatives, but no compensation will be provided for the unavailability of single accommodations.
3. Cancelations and Refunds
  • Refunds for cancellations will be provided solely in the form of travel credits, in accordance with our Credit Policy (see 3.4). These credits are subject to the terms outlined and cannot be converted into cash.
  • 3.1 Cancellation by You Cancellation requests must be submitted in writing via email and will only take effect once acknowledged by Mauresk in writing. The following cancellation fees apply:

    • More than 60 days before departure: You will forfeit your deposit. The deposit amount is non-refundable as it is used to secure your spot and cover administrative costs.
    • 60 days or less before departure: You will be charged 100% of the total trip cost. This is due to commitments we make to our vendors and partners, which cannot be reversed within this time frame.
  • 3.2 Cancellation by Us Mauresk reserves the right to cancel a trip in circumstances where we cannot safely or reasonably operate the trip as planned. Reasons may include but are not limited to insufficient participant numbers, operational challenges, or supplier issues. In such cases:
    • A full refund of amounts paid will be offered, minus any non-recoverable costs.
    • Mauresk will not be responsible for additional costs incurred by travelers, such as non-refundable flights, visas, or travel insurance.
  • 3.3 Cancellations Due to Force Majeure A Force Majeure Event refers to extraordinary circumstances beyond the control of Mauresk or the traveler that make it unsafe or impossible to proceed with the trip. Examples include natural disasters, pandemics, civil unrest, extreme weather, or government-imposed restrictions.

    • After Departure: Mauresk will issue compensation for the unused portion of the trip, provided as a future travel credit or refund, adjusted for any non-recoverable costs already incurred. Travelers are responsible for incidental expenses, including visa fees, vaccinations, travel insurance premiums, or non-refundable transportation costs. Mauresk reserves sole discretion to determine whether a Force Majeure Event applies. Refunds or credits will be issued based on non-recoverable costs already incured. Mauresk will provide compensation in the form of a travel credit equal to the amounts paid or a refund, minus any non-recoverable costs.

    In the event of a Force Majeure Event, Mauresk reserves the right to modify itineraries, substitute services, or offer alternative dates to ensure continuity of services.
  • 3.4 Credit & Refund Policy Mauresk does not generally issue cash refunds. Refunds for cancellations are primarily provided in the form of travel credits, representing the amounts paid, less any non-recoverable costs incurred by Mauresk, such as payments to third-party suppliers. Travel credits are valid for a specified period, as detailed at the time of issuance, and can be applied toward future bookings with Mauresk.

    Cash refunds will only be issued under the following circumstances:

    • Cancellations by Mauresk: If Mauresk cancels a trip, travelers may receive a cash refund, less any non-recoverable costs incurred.
    • Cancellations by the Traveler (More Than 60 Days Before Departure): If a traveler cancels their booking more than 60 days before the trip's departure date, Mauresk may issue a cash refund, less the non-refundable deposit and any non-recoverable costs.

    Travel credits provided to travelers may be subject to additional costs if there are changes in seasonality, demand, or other factors affecting the trip pricing. For example, rebooking during peak travel periods, changes in accommodation rates, or currency fluctuations may result in increased trip costs, which will be communicated at the time of rebooking.

    Additionally, since Mauresk works with small, local businesses and independent operators, some funds may be non-recoverable due to the nature of prepayments and commitments made to our partners. Travelers acknowledge and accept that such unrecoverable costs may impact the total value of any cash refund or travel credit issued

4. Changes to Booking
  • 4.1 By You Requests for changes must be made in writing. While we will endeavor to accommodate changes, we cannot guarantee all requests can be met. Additional costs may apply.

  • 4.2 By Us We reserve the right to make changes to your itinerary due to circumstances beyond our control. While we will do our best to minimize disruption, we are not liable for any resulting inconvenience or additional costs. No refunds will be issued for changes to the itinerary.

5. Prices and Surcharges
  • Trip prices are influenced by a variety of factors, including demand, market conditions, and seasonal trends. As such, prices may fluctuate at any time, and travelers on the same trip may pay different rates based on the timing of their booking. If you find a price that works for you, we recommend booking immediately to lock it in.
    Once your booking is confirmed, any new discounts or price reductions cannot be applied retroactively. Should you decide to cancel your booking to take advantage of a new rate, the cancellation policy under clause 3.1 (Cancellation by You) will apply.
    The most accurate and up-to-date pricing is displayed on our website. Prices are based on currency exchange rates as of January 2025 and may vary depending on the currency in which payments are made. While we strive to provide accurate information, errors in pricing or trip details may occur. Mauresk reserves the right to correct such errors and adjust prices before issuing a booking confirmation invoice.
    Surcharges may be imposed up to 60 days prior to departure due to unfavorable changes in exchange rates, transportation costs, taxes, or government-mandated fees. Mauresk will absorb up to 2% of the trip price in such cases, with the remaining costs passed on to the traveler. If the surcharge exceeds 10% of the total trip cost, you may cancel your booking within 30 days of notification and receive a full refund. Please note that credit card transactions may incur additional fees.
    Outstanding balances may be adjusted to account for currency fluctuations occurring before final payment.
6. Travel Insurance
  • Travel insurance is mandatory for all travelers and must be obtained at the time of booking. Your travel insurance must provide coverage for personal accident, death, medical expenses, and emergency repatriation, with a recommended minimum coverage of USD 200,000 for each category. Additionally, it is strongly recommended that the insurance covers cancellation, trip interruption, personal liability, and loss of luggage or personal effects. Travelers are required to provide their travel insurance policy number and the insurance company's 24-hour emergency contact information on the first day of the trip. Without these details, participation in the trip will not be permitted. If your travel insurance is associated with a credit card or bank account, ensure you have the insurer's name, policy number, and emergency contact information, rather than just the bank or credit card details. . Proof of insurance is required before departure.

    Travelers who fail to provide proof of adequate travel insurance will not be permitted to join the trip, and no refund will be issued.
7. Health, Fitness, and Risk Awareness
  • 7.1 Health and Vaccinations To participate in our trips, you must be in good health. It is your responsibility to consult with a physician to confirm your fitness for travel and to obtain any necessary vaccinations. Travelers are solely responsible for assessing their physical capabilities and understanding the risks associated with the activities outlined in their itinerary. Mauresk may provide general health guidance, but travelers are ultimately responsible for meeting health requirements specific to their destinations.
  • 7.2 Acceptance of Risk Participation in our trips may involve personal risk, including adventurous activities and visits to regions with challenging weather, cultural differences, or other external factors. By booking a trip, you acknowledge and accept these risks, understanding the unique challenges that may arise. Travelers are encouraged to research and prepare themselves for all relevant risks.
    Mauresk is not liable for any risks or adverse outcomes associated with your decision to travel. If you are unable to complete the trip for any reason, no refund will be provided.
8. Passport and Visa Requirements
  • Travelers are responsible for ensuring their passport is valid for at least six months beyond the duration of the trip and for obtaining all necessary visas, permits, or travel documentation required for their destination. Travelers are also responsible for obtaining any necessary transit visas required for connecting flights or layovers. Mauresk will not be liable for any disruptions to your trip caused by failure to secure the appropriate documents. If a traveler is unable to participate in the trip due to incomplete or incorrect documentation, no refund or credit will be provided.
9. Sustainability and Respect
  • As part of Mauresk's commitment to sustainable and mindful travel, you must respect local customs, communities, and environments. Any disrespectful or harmful behavior may result in removal from the trip without refund.
10. Liability
  • 10.1 Our Liability Mauresk acts as an agent for third-party suppliers, including accommodations, transportation, and activity providers, and is not liable for any acts or omissions of these suppliers. Our liability is limited to the total amount you have paid for your trip. While we strive to ensure the safety and quality of your experience, we cannot guarantee the performance or compliance of third-party providers with local laws or standards.
    Mauresk cannot warrant that third-party providers comply with specific standards or laws in the traveler’s home country or destination.
  • 10.2 Your Responsibility You are responsible for your actions during the trip. Mauresk reserves the right to remove any participant whose behavior is deemed inappropriate, unsafe, or disruptive without a refund. Additionally, you are expected to comply with all applicable local laws and customs in the destinations you visit. Failure to do so may result in your removal from the trip.
  • 10.3 Indemnity You agree to indemnify Mauresk, including its employees, agents, and representatives, against any claims, damages, or losses arising from:
    • Your actions or omissions during the trip.
    • Any breach of these Terms and Conditions.
    • Non-compliance with local laws or requirements.
    This indemnity includes all legal fees and costs incurred by Mauresk in defending such claims.
  • 10.4 Vicarious Liability Mauresk is not liable for the intentional or negligent actions of individuals not directly employed by us, including independent contractors or third-party providers. Additionally, we disclaim responsibility for actions of our employees that occur outside their authorized scope of work.
  • 10.5 Limitation of Liability Where guarantees or warranties are implied by law and cannot be excluded, Mauresk’s liability is limited to re-supplying the services or reimbursing the cost of having the services supplied again. Mauresk does not accept liability for indirect or consequential damages, including personal injury or property damage, except in cases of fraud or willful misconduct.
  • 10.6 Third-Party Providers While Mauresk carefully selects its third-party providers, such as local operators, accommodation providers, and transportation services, we are not responsible for their acts or omissions. Any disputes or claims relating to third-party services must be resolved directly with the provider. Third-party terms and conditions may also apply to specific services, and travelers are required to review and accept these terms as necessary.

11. Authority of the Tour Guide
  • Travelers are required to follow the instructions and guidance of their designated tour guide throughout the trip. The tour guide’s primary role is to ensure the safety, enjoyment, and smooth operation of the itinerary for all participants. By participating in a Mauresk trip, you agree to respect and adhere to the guide's decisions, including itinerary adjustments, group management, and safety protocols.
    Non-compliance with the tour guide’s instructions may result in removal from the trip without refund. Mauresk will not be held responsible for any consequences arising from a traveler’s failure to follow the tour guide’s authority.
12. Complaints
  • If you have a complaint during your trip, please inform your tour leader immediately so that it can be addressed. If the issue is not resolved, you may submit your complaint in writing to Mauresk within 30 days of the trip's conclusion.
13. Governing Law and Dispute Resolution
  • 13.1 Governing Law This Agreement is governed by the laws of the State of Rhode Island, USA. By booking with Mauresk, you agree that any disputes or claims arising from these Terms and Conditions shall be resolved under Rhode Island law.
  • 13.2 Waiver of Class Action and Jury Trial Mauresk and its clients agree that disputes will be addressed individually. Both parties waive the right to initiate or participate in any class action, collective lawsuit, or representative legal proceeding. Additionally, both parties waive the right to a jury trial, ensuring that disputes are resolved through mediation or individual legal proceedings.
  • 13.3 Mediation and Dispute Resolution In the event of a dispute, both parties agree to attempt resolution through good faith negotiations. If a resolution cannot be reached, the matter will be referred to mediation, facilitated by a mutually agreed mediator or an independent body such as the American Arbitration Association. Mediation will take place in Rhode Island, and costs will be shared equally.
    If mediation fails to resolve the dispute, the matter may proceed to binding arbitration or litigation in the appropriate Rhode Island court, as determined by mutual agreement or legal requirements.

  • 13.4 Only Travelers May Raise Complaints or Disputes Only travelers who have directly booked with Mauresk and are part of the trip can raise complaints or disputes regarding the services provided. Third parties, including but not limited to family members, friends, or other representatives of the traveler, are not entitled to bring claims or disputes against Mauresk. This clause ensures that all matters are addressed directly with the individuals bound by this agreement.
14. Photographs and Media Use
  • Mauresk may capture photographs and videos during trips for promotional purposes. By participating, you consent to the use of such materials unless you explicitly notify Mauresk in writing before the trip. Such media may be used on our website, social media, or promotional materials without further acknowledgment or compensation.
15. Privacy Policy
  • 15.1 Privacy Policy Your privacy is important to us. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your personal data.
  • 15.2 Data Security Disclaimer While we take reasonable measures to protect your personal data, Mauresk cannot guarantee the security of electronic communications or data transfers. By using our services, you acknowledge and accept the inherent risks associated with online transactions and communications.
16. Acknowledgment of Risk
  • By booking with Mauresk, you acknowledge that participation in our trips involves inherent risks, including but not limited to personal injury, illness, property loss or death. You voluntarily assume all such risks and release Mauresk from liability.
17. Severability
  • If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
  • This Agreement constitutes the entire understanding between you and Mauresk, superseding any prior agreements, representations, or understandings.
